1. About Us & Licensing

In Bloom Cannabis ("we", "us", "our") is a cannabis retail store authorized by the Alcohol and Gaming Commission of Ontario (AGCO) under the Cannabis Licence Act, 2018. Our store is located at 1831 Main St W, Hamilton, ON L8S 1H6. By accessing this website, placing an order, or visiting our store, you agree to these Terms & Conditions. All cannabis we sell is sourced from the Ontario Cannabis Store (OCS), as required by Ontario law.

2. Age Restrictions & ID

You must be at least 19 years old to access this website, place orders, or purchase cannabis products from us. The website displays an age-verification gate at entry; by selecting "Yes" you confirm you are 19 or older.

• Valid government-issued photo ID is required at the time of in-store purchase, pickup, and delivery, regardless of apparent age.
• We will refuse service to anyone unable to produce acceptable ID, anyone who appears intoxicated, or anyone we reasonably suspect is purchasing on behalf of a minor.
• It is an offence under the Cannabis Control Act, 2017 to supply cannabis to a person under 19.

3. Ontario & Federal Cannabis Law

All sales comply with the federal Cannabis Act and the Ontario Cannabis Licence Act, 2018, Cannabis Control Act, 2017, and AGCO Registrar's Standards. Customers are responsible for understanding the law that applies to them, including:

• Adults may possess up to 30 grams of dried cannabis (or equivalent) in public.
• Cannabis may not be consumed in vehicles, workplaces, or most indoor public places.
• Driving while impaired by cannabis is illegal and dangerous.
• Cannabis may not be transported across the Canadian border in either direction.

4. Online Ordering & Acceptance

Orders placed through our website, chat assistant ("Bloom"), or third-party menu integrations (such as Buddi) are offers to purchase for in-store pickup or local delivery, subject to availability, identity verification, and our acceptance. No contract of sale is formed until we confirm the order and successfully verify the buyer's identity and age at fulfillment. Prices, product availability, and promotions may change without notice. We reserve the right to refuse, limit, or cancel any order at our discretion, including for suspected fraud, intoxication, attempts to purchase on behalf of a minor, or quantity that would exceed legal possession limits.

5. Payment & Currency

All prices are in Canadian Dollars (CAD) and include applicable HST unless otherwise stated. We accept Visa, Mastercard, Interac Debit (in store), and cash (in store).

• Online card payments are processed by our authorized Canadian payment processor through a PCI-DSS compliant gateway. We do not store full card numbers on our servers.
• You confirm that any card or account used to pay is yours and that you are authorized to use it.
• Charges will appear on your statement under a descriptor that includes "In Bloom Cannabis" or a related identifier.
• Declined transactions, chargebacks, or fraud holds may delay or cancel an order.

6. Pickup, Delivery & Shipping

In-store pickup. Orders are typically ready within 30 minutes during business hours. Pickup is at 1831 Main St W, Hamilton, ON L8S 1H6. Government-issued 19+ photo ID matching the order name is required to collect.

Local delivery. We offer same-day delivery within designated postal codes in the City of Hamilton during open hours (10:00 AM – 11:00 PM, daily). A minimum order value, delivery fee, or free-delivery threshold may apply and will be shown at checkout.

• An adult 19 years or older with valid photo ID matching the order must be present to receive the delivery. Orders cannot be left unattended, with a minor, or with anyone unable or unwilling to provide ID.
• If no eligible recipient is available after a reasonable attempt, the order is returned to the store and may be subject to a restocking fee.
• We do not ship cannabis by mail or courier and do not deliver outside our authorized delivery zone.
• Estimated times are not guarantees; weather, traffic, or volume may delay delivery.

7. Returns, Refunds & Cancellations

In accordance with AGCO Registrar's Standards and public-health rules, cannabis products are final sale and cannot be returned, exchanged, or resold once they leave our store. Limited exceptions:

• Order not yet fulfilled. You may cancel an online order at no charge before it has been packed for pickup or dispatched for delivery. Contact us at sales@inbloomcannabis.ca or (365) 883-3188.
• Confirmed product defect or recall. If a sealed product is defective, contaminated, or subject to a Health Canada or producer recall, contact us within seven (7) days of purchase with your receipt or order number. We will work with you and the supplier on a remedy permitted by AGCO rules, which may include exchange, store credit, or a refund to the original payment method.
• Order error on our part. If we shipped or handed you the wrong item, contact us within 48 hours of pickup or delivery and we will correct the error at no additional cost.
• Refund timing. Approved refunds are issued to the original payment method within 5–10 business days. Card-network processing times may add additional days for funds to appear.
• Chargebacks. Please contact us before initiating a chargeback so we can resolve the issue directly.

8. Health & Safety

Cannabis affects each person differently. Start with a low dose, especially with edibles, and wait at least two hours before consuming more. Cannabis is not recommended for people who are pregnant, breastfeeding, planning to drive or operate machinery, or have a personal or family history of psychosis or mental illness. Consult a healthcare professional before use if you have a medical condition or take prescription medication. We do not make medical or therapeutic claims about any product.

9. Prohibited Use

You agree not to:

• Misrepresent your age, identity, or eligibility to purchase.
• Purchase cannabis on behalf of, or for redistribution to, a person under 19 or any unauthorized third party.
• Resell our products outside the AGCO-licensed retail framework.
• Use the website to commit fraud, launder funds, or violate any law.
• Attempt to bypass age verification, scrape the site, or disrupt its operation.

10. Website Use & Intellectual Property

Content on this website, including the "In Bloom Cannabis" name, logos, photography, copy, and product descriptions, is owned by us or licensed to us and is provided for informational purposes only. It does not constitute medical advice. We make reasonable efforts to keep information accurate, but make no warranty as to accuracy, completeness, or availability. You may not reproduce, redistribute, or modify the content without our prior written consent.

11. Privacy

Personal information collected through this website, our ordering system, in-store loyalty enrolment, or chat assistant is handled in accordance with our Privacy Policy and the federal Personal Information Protection and Electronic Documents Act (PIPEDA). We do not sell your personal information. By using this site you consent to the practices described in the Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by law, In Bloom Cannabis, its owners, employees, and suppliers are not liable for any indirect, incidental, special, or consequential damages arising from your use of this website, our products, or our services, including any effects of cannabis consumption. Our total aggregate liability for any claim is limited to the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts located in Hamilton, Ontario have exclusive jurisdiction over any dispute, except where Ontario consumer-protection law gives you a right to proceed elsewhere.
